The wave of injunctions (You can keep track here.) against President Trump’s policies—especially his efforts to streamline the federal government—is a clear example of lawfare: using the legal system as a political weapon to delay, obstruct, or derail policies. This has become the go-to strategy for Democrats and activist judges who oppose Trump’s governance style.
I. The Injunction Blitz: A Coordinated Strategy
The number of nationwide injunctions against Trump is unprecedented, even compared to his first term.
These lawsuits primarily target executive orders, regulatory rollbacks, and government downsizing.
Democrat-aligned groups and state attorneys general engage in judge-shopping, filing cases in circuits more likely to issue injunctions. (Blue judges?)
Cases are strategically placed before Obama- or Biden-appointed judges, ensuring maximum delays. (Blue judges?)

III. The Current Goal: Delay. The End Goal: Save the Administrative State
Courts take months or years to resolve cases; the goal isn’t necessarily to win, but to stall Trump’s agenda.
Most cases will eventually reach the Supreme Court, but by then, delays may have caused damage.
Similar tactics were used against Trump in his first term, slowing implementation of key policies.

This shifting of power is how the administrative state came to be - the rise of the administrative state and the erosion of direct executive authority—both of which were done without direct constitutional amendments or public votes. This shift happened due to a combination of Congressional maneuvering, court decisions, and unchecked bureaucratic expansion.
The intent is to set a precedent where activist courts, not voters or elected officials, dictate national policy.
Unchecked judicial activism can kill governance and the constitutional balance of powers. America has already been subject to agencies and other bureaucracies, the administrative state, that are not lawful and some directly oppose the Constitution.
VI. Trump Can Win the Fight Against Lawfare
Leveraging Recent SCOTUS Decisions – Using Loper Bright (Chevron overturned) to limit agency overreach.
Pushing Cases to SCOTUS – Accelerating appeals to reach higher courts minimizing injunctions intended to stall key policies.
Congressional Action – Pushing for legislation to limit nationwide injunctions and rein in rogue judges. Congress can make Trump’s plans into law. Republicans are the majority and must take action on this.
Public Exposure – Using unbiased media and public engagement to bring to light that lawfare is the true attack on democracy. Transparency, transparency, transparency.
VII. The Bottom Line
Trump’s battle against the administrative state is being fought in the courts even as his new policies are being implemented.
The left’s current strategy is stalling to keep the deep state intact because no one but President Trump has been such a threat to their growing control.
Expect more lawsuits, more judicial activism, and more Supreme Court battles in the months ahead. The sooner there is a Supreme Court decision, the more Trump can accomplish.
In spite of it all, it’s amazing what has been accomplished, the frauds and abuses that have been uncovered, and the transparency that has been brought to the American people.
